These Terms of Service ("Terms") govern your use of the websites operated by Moon King Entertainment Group ("Moon King," "we,""us," or "our"), located at 10 Buck Island Rd, Bluffton, SC 29910, and any purchases you make through them. By accessing our websites, subscribing to our newsletter, purchasing a gift card, or ordering spirits online, you agree to these Terms. If you do not agree, please do not use our websites.
These Terms apply to moonkingentertainment.com and to the websites of our brands: The Bank, Burnt Church Distillery, Hail Mary's Spirits & Sports Bar, Amethyst NA Spirits, Side Hustle Brewing Co., Old Route 69 Brewery, and The Press Room.
Eligibility
You must be at least 18 years old to use our websites, subscribe to our newsletter, or purchase a gift card. Certain areas of our websites relate to alcoholic beverages and are intended only for visitors who are of legal drinking age in their jurisdiction. By using those areas, you confirm that you are 21 years of age or older. We reserve the right to refuse service, cancel orders, or restrict access where we reasonably believe an age requirement has not been met.
Burnt Church Distillery offers spirits for purchase online through its website. You must be at least 21 years old to order spirits online, and you may only purchase spirits for personal consumption and not for resale. Alcohol sold through any other Moon King brand is served and sold only at our licensed physical locations, in accordance with South Carolina law.
Use of Our Websites
You may use our websites for your own personal, non-commercial purposes: browsing our brands, viewing menus and hours, subscribing to our newsletter, purchasing gift cards, and purchasing spirits offered online by Burnt Church Distillery. You agree not to:
- Use our websites for any unlawful purpose or in violation of these Terms
- Attempt to gain unauthorized access to any part of our websites, servers, or accounts
- Interfere with or disrupt the operation of our websites, including through automated scraping, bots, or denial-of-service activity
- Submit false, misleading, or fraudulent information, including in connection with a gift card purchase or online spirits order
- Order alcohol on behalf of anyone under 21 or arrange for delivery to a person under 21
- Copy, reproduce, or redistribute content from our websites without our written permission
- Resell gift cards or use them for any commercial purpose without our written authorization
We may suspend or terminate your access to our websites at any time, without notice, if we believe you have violated these Terms.
Newsletter and Email Communications
When you submit your email address through a form on our websites, you consent to receive newsletters, event announcements, promotions, and updates from Moon King Entertainment Group and its brands. Email frequency varies. You can unsubscribe at any time using the link at the bottom of any marketing email we send, or by contacting us at info@moonkingentertainment.com.
We may still send you transactional messages relating to an order you place, such as gift card confirmations and delivery notices or spirits order confirmations and shipping updates, even if you have unsubscribed from marketing email.
Gift Cards
Gift cards for our brands are sold and administered through Toast, our payment and gift card provider. By purchasing a gift card, you agree to the following terms in addition to any terms presented at checkout.
- Redemption. Gift cards are redeemable at any Moon King Entertainment Group brand, regardless of which brand the card was purchased through, including The Bank, Burnt Church Distillery, Hail Mary's Spirits & Sports Bar, Amethyst NA Spirits, Side Hustle Brewing Co., Old Route 69 Brewery, and The Press Room. If we add or remove a brand or location, the brands participating at the time of redemption will apply.
- No expiration. Gift cards do not expire and are not subject to dormancy, inactivity, or service fees, except as permitted by applicable law.
- No cash value. Gift cards may not be redeemed for cash, except where required by law, and cannot be applied to a previously completed purchase.
- Non-refundable. Gift card purchases are final and non-refundable once delivered.
- Delivery. Gift cards are delivered electronically to the email address provided at checkout. You are responsible for entering the correct recipient email address. We are not responsible for gift cards delivered to an incorrect address supplied by you, or for delivery failures caused by spam filters or an inactive email account.
- Lost or stolen cards. We are not responsible for gift cards that are lost, stolen, forwarded, or used without your permission. Treat a gift card code like cash.
- Balances. Any unused balance remains on the gift card. If a purchase exceeds the balance, the difference must be paid by another accepted payment method.
- Alcohol. Gift cards may be used toward alcoholic beverages only where permitted by law and only by guests of legal drinking age, at the discretion of the serving location. Gift cards cannont be used for online bottle purchases from Burnt Church Distillery.
Toast's processing of your payment and gift card information is governed by its own terms and privacy policy. We are not responsible for outages, errors, or delays caused by Toast or other third-party providers.
Online Alcohol Sale and Shipping
Spirits purchased online from Burnt Church Distillery are sold subject to the following terms, in addition to any terms presented at checkout. Orders are placed through the Burnt Church Distillery website using Shopify and are processed and fulfilled by licensed retailer partners of Big Thirst, Inc.
- Age verification. You must be 21 or older to place an order. By ordering, you certify that your are 21 or older and that the person receiving the shipment is 21 or older. We may use a third-party age verification service and may require additional proof of age before shipping.
- Delivery and Signature. An adult 21 or older must be present to sign for the delivery with valid government-issued photo identification. Packages will not be left unattended. Deliveries cannot be made to a school, a prison, or any other location prohibited by law.
- Where we ship. Spirits can be shipped to most U.S. states and the District of Columbia. Availability depends on the laws of your state and on the licenses held by the fulfilling retailer partner, and the states we can ship to may change. Shipping eligibility for your address is confirmed at checkout. Orders placed for delivery to a jurisdiction where direct shipment is not permitted will be cancelled and refunded, and order quantities may be limited as required by applicable law.
- Who sells and fulfills your order. All online spirits sales are processsed and fulfilled by licensed retailer partners of Big Thirst, Inc. The retailer partner that accepts your order is the seller of record for that transaction and is responsible for fulfillment and shipment. Title to and ownership of the product passes to you at the retailer partner's licensed premises. You are responsible for complying with the alcohol laws of your state and locality, including any applicable taxes or reporting obligations.
- Payment. Online orders are processed through Shopify. Payment card information is handled by Shopify and its payment processors; we do not receive or store your full payment card number.
- Gift cards not accepted. Moon King and brand gift cards cannot be used to purchase bottles online. Gift cards are redeemable only at our physical locations.
- Failed or refused deliveries. If a delivery cannot be completed because no eligible adult is available, identification is not provided, or the address is inaccurate or prohibited, the shipment may be returned to the fulfilling retailer partner. Return shipping and any applicable restocking or handling fees are your responsibility and may be deducted from any refund.
- Returns. Because of laws governing alcohol sales, spirits are not returnable or refundable once delivered, except where a product arrives damaged or defective or where a refund is required by law. Returns, refunds, and claims for damaged or missing shipments are handled by the fulfilling retailer partner and Big Thirst, Inc. under their policies. Contact us at info@moonkingentertainment.com or the support contact shown in your order confirmation within 15 days of delivery, and we will direct your claim to the right party.
- Resale prohibited. Spirits purchased online are for personal consumption only and may not be resold. Attempting to purchase alcohol for someone under 21, or providing false information about your age, is a violation of these Terms and may be a violation of state and federal law.
Pricing, Orders, and Payment
All prices are shown in U.S. dollars and are subject to change without notice. We make reasonable efforts to keep pricing and product information accurate, but errors can occur. If a gift card, bottle, or other item is listed at an incorrect price, we reserve the right to cancel or refuse the order, even after a confirmation has been sent, and to refund any amount charged.
Gift card payments are processed by Toast at the time of purchase. Online spirits orders are processed through Shopify and fulfilled by licensed retailer partners of Big Thirst, Inc. By submitting an order, you represent that you are authorized to use the payment method provided. We reserve the right to refuse or cancel any order we reasonably believe to be fraudulent, unauthorized, placed by a person under the legal purchase age, or otherwise in violation of these Terms.
Menus, Hours, and Availability
Menus, pricing, hours of operation, events, and product availability shown on our websites are provided for general information and are subject to change without notice. Items, brands, and locations may be modified, suspended, or discontinued at any time. We recommend contacting the location directly to confirm current hours and availability before visiting.
Nutritional, allergen, and ingredient information, where provided, is approximate. Our kitchens and production areas handle common allergens, and we cannot guarantee that any item is free from a specific allergen. If you have a food allergy ordietary restriction, please speak with a manager at the location before ordering.
Intellectual Property
All content on our websites, including text, graphics, logos, brand names, photographs, menus, videos, and site design, is owned by Moon King Entertainment Group or its licensors and is protected by copyright, trademark, and other intellectual property laws. The names and logos of our brands are trademarks of Moon King Entertainment Group or its affiliates.
You may view and share our content for personal, non-commercial purposes. You may not reproduce, distribute, modify, or use our content or trademarks for commercial purposes without our prior written consent.
Third-Party Services and Links
Our websites are hosted on Webflow, our email marketing is delivered through Mailchimp, gift card sales are processed through Toast, and online spirits orders for Burnt Church Distillery are processed through Shopify and fulfilled by retailer partners of Big Thirst, Inc. Our websites may also link to third-party services such as social media platforms, reservation or ticketing providers, and delivery partners. We do not control these services and are not responsible for their content, availability, terms,or practices. Your use of a third-party service is governed by that provider's own terms, and orders fulfilled by a retailer partner are also subject to that retailer's terms and policies.
Privacy
Our collection and use of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference. By using our websites, you also agree to the terms of our Privacy Policy.
Disclaimers
Our websites and all content on them are provided on an "as is" and "as available" basis, without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that our websites will be uninterrupted, secure, error-free, or free of viruses or other harmful components, or that any information on them is complete, accurate, or current.
Limitation of Liability
To the fullest extent permitted by law, Moon King Entertainment Group, its brands, affiliates, owners, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or good will, arising out of or relating to your use of our websites or any purchase made through them, whether based in contract, tort, warranty, or any other legal theory, even if we have been advised of the possibility of such damages.
To the fullest extent permitted by law, our total liability arising out of or relating to these Terms or your use of our websites will not exceed the amount you paid to us in the twelve months preceding the event giving rise to the claim, or one hundred U.S. dollars ($100), which ever is greater.
Nothing in this section limits the obligations of a fulfilling retailer partner as the seller of record for an online spirits order. Some jurisdictions do not allow the exclusion of certain warranties orthe limitation of liability for certain damages, so some of the above may not apply to you.
Indemnification
You agree to indemnify and hold harmless Moon King Entertainment Group, its brands, affiliates, and their respective owners, officers, employees, and agents from any claims, damages, losses, liabilities, and expenses, including reasonable attorneys' fees, arising out of your use of our websites, your violation of these Terms, or your violation of any law or the rights of a third party.
Changes to These Terms
We may update these Terms from time to time. Changes will be posted on this page with an updated "Last Updated" date and take effect when posted. Your continued use of our websites after changes are posted constitutes acceptance of the revised Terms.
Governing Law and Venue
These Terms are governed by the laws of the State of South Carolina, without regard to its conflict of law provisions. You agree that any dispute arising out of or relating to these Terms or your use of our websites will be brought exclusively in the state or federal courts located in Beaufort County, South Carolina, and you consent to the jurisdiction of those courts.
Severability and Entire Agreement
If any provision of these Terms is found to be unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will stay in full force. Our failure to enforce any provision is not a waiver of our right to do so later. These Terms, together with our Privacy Policy and any terms presented at checkout, are the entire agreement between you and Moon King Entertainment Group regarding your use of our websites.
